Abali argued the 2012 rezoning and recorded deed covenants for Parcel 2 allow only "an on grade parking lot and accessory structures" in support of the adjoining commercial building; he said placing a public refueling use there conflicts with those restrictions and recommended the town require site‑plan review and a public hearing before the chargers are allowed to operate for the general public.
Abali asked staff to enforce the 2012 resolution and deed covenants or, if necessary, to amend Town Code §70‑203 P1 to explicitly require site‑plan review for public EV charging stations, arguing those installations raise traffic‑flow, circulation and hours‑of‑operation concerns that are normally addressed through site‑plan review. He offered to provide photographs and copies of the recorded deed language to the town.
Town staff did not take an immediate enforcement action during the meeting; the board acknowledged the complaint and public‑comment request for a formal review. No board decision was made that night; the public commenter asked the board to treat public EV chargers as an independent refueling business requiring site plan review and enforcement of the 2012 recorded covenants.
