Box Elder Council Approves BID Pass-through, Easement and Amended Audit Engagement

The Box Elder City Council approved three administrative actions that city staff said were necessary to support capital projects and standard financial oversight.
City attorney described an operations and maintenance agreement that will allow the city to pass Business Improvement District (BID) #3 funds through to Box O and M LLC, the entity responsible for operating and maintaining the Box event center. The BID assessment was created at hotel owners’ request to offset event-center operational losses; Councilmember Davis moved to approve the agreement and the council passed it by roll call.
Scott Lang, city engineer, presented a voluntary right-of-way donation easement from Rodney Vollmer tied to the Bennett Road project. Lang said this was the third and final easement needed; once accepted and recorded the South Dakota DOT will allow the city to bid the Bennett Road project. The council voted to accept the easement and authorized the mayor to sign the right-of-way certificate.
Renee Baker, interim finance officer, explained the city had already signed an engagement letter with Casey Peterson LTD for the 2024 audit but needed to add single-audit language after the city received more than $4,750,000 in federal funding. Baker said no other terms or audit timing changed; the council approved the revised engagement letter by roll call.
