Bulverde — The City Council approved two special use permits Tuesday to allow accessory "guest houses" in new Thornbrook subdivision developments and directed staff to review whether city ordinances need cleanup to address design and enforcement concerns.
Planning staff told the council the application at 1032 Sidaway Lane proposes a 634-square-foot guest house and that later models could be larger. "This particular one is being proposed at 634 square feet," planning staff said. The Planning & Zoning Commission had recommended approval of both that application and a similar request at 1014 Rapides.
Council members raised several concerns during discussion. One member asked whether builder marketing could create confusion if sales materials promise features the city might later deny; planning staff said staff had contacted the builder about marketing language and that the city enforces the special use permit. On the question of exterior materials, planning staff said state law has limited local authority: "We're not allowed to regulate that anymore," staff said, adding that the city is working on a code cleanup.
Council also probed infrastructure and sequencing: planning staff said roads for the section with the Sidaway Lane property had been completed and that pre-construction surveys are required to ensure accessory structures meet setback and location standards.
Councilmember (Speaker 4) moved to approve the ordinance granting the special use permit for 1032 Sidaway Lane; the motion was seconded and carried on a voice vote. The council then held a public hearing and approved the similar permit for 1014 Rapides after a short discussion about tree impacts raised during the Planning & Zoning review.
