Council authorizes land acquisitions and eminent-domain authority for drainage and sewer projects
Summary
Denton authorized property acquisitions and eminent-domain authority for the Neighborhood 5B Oakland Drainage project (about 10.4 acres) and the North Moss Branch sewer extension (approximately 9,000 linear feet), both passed 7–0.
The council on Dec. 16 authorized staff to make offers and to use eminent domain if necessary to acquire property interests for two infrastructure projects:
- Neighborhood 5B Oakland Drainage: staff requested acquisition of roughly 10.416 acres plus about 1.283 acres of temporary construction easement to build a regional detention pond expected to remove about 57 acres from the floodplain; staff recommended adoption of the ordinance and eminent-domain authority as needed. Angel Delore, senior real estate specialist, presented the project and schedule with construction expected to begin in Q1 2027 and finish in Q4 2028.
- North Moss Branch Sewer Project: deputy director Deanna Cody presented plans to construct approximately 9,000 linear feet of sanitary sewer to serve the Hickory Creek service area; staff noted many easements have already been acquired and recommended authorization to acquire remaining permanent and temporary easements and eminent-domain authority if negotiations fail. Council authorized both ordinances, each passing 7–0.
Staff said acquisitions will follow statutory offer and appraisal procedures before eminent-domain filings.
