• Ace Theater (503–505 Congress St.) — Use variance approved, subject to specified findings and three conditions (see separate coverage).
• Variance extensions — Two previously approved variances for properties at the southeast corner of Saint Louis and North Claiborne (agenda items 2 and 3) received six-month extensions after applicants said they were addressing permit comments; the board approved both extensions.
• Dealership signage — A BMW dealership on Government Boulevard received approval to refinish/replace three wall signs and two freestanding signs; staff said the requests are refacing rather than new sign locations.
• Appeal upheld (1552 Duval St.) — The board upheld an appeal restoring a commercial nonconforming B3 use for the metal building at 1552 Duval Street after the owner presented tax-assessment and affidavit evidence of long-standing commercial/storage use; the board determined the nonconforming use should be recognized and voted to grant the appeal.
• Transparency variances — Two residential duplex projects that had ARB approval but conflicted with CRC commercial transparency requirements were granted transparency variances so ARB-approved window placement can prevail in the residential context.
• Setback variance — A covered screened porch with fireplace at 59 Battery Lane (Gilmore Homes) was approved after staff confirmed a later addendum showing an existing perimeter block wall; the board accepted the addendum and approved the variance with findings.
• Special exception for micro school (case 6729610) — An education company seeking to use half of a building as a private K–8 micro school won a special exception; board members limited hours and classrooms in line with staff recommendations and noted any private closing-agreement restrictions (provided by the University of South Alabama) must be addressed outside the board’s decision.
Several items were approved by motion and voice votes; where the transcript did not include roll-call tallies, results are recorded as the board announced them in open session. The board also received a legal update that a court overturned a prior board denial in an HVAC variance appeal.
