Layton resident tells Davis County Commission more than 5,000 mail-in ballots may have gone uncounted

During the public-comment period at the July 15 meeting, Jennifer Garner of Layton told the Davis County Commission she believed more than 5,000 mail-in ballots were not counted because voters were notified too late that they needed to sign affidavits.

Garner described attempting to vote on the last day of counting, placing her ballot in the Davis Conference Center drop box and discovering the signature cover had torn. She said she later received a notification two business days before counting ended asking her to come in and sign an affidavit, and she said she believed that timeline contributed to thousands of ballots being excluded from counts.

Commissioners did not provide an on-the-record technical response during the meeting, but a county official later asked Garner to meet after the meeting to review any emailed documentation. "I did check my emails. I do not have that email. And so if she's available to visit after this meeting, happy to chat and answer any questions I can," an official said.

The commission did not take formal action on the comment during the meeting. The clerk's office said staff would follow up with Garner to examine her concerns and any supporting documentation.
