Messenger said the county respects the accessibility law’s intent but has identified ambiguities in the implementing rules that could create significant exposure for local governments. He asked whether the board would like the county to sign up to testify and offer clarifying implementation comments; the board directed the attorney’s office to prepare testimony and coordinate with staff.
On Rollinsville, Messenger described three lines of inquiry for rights-of-way and title issues: preliminary systemic review already underway through public-works and GIS upgrades, site-specific title and historical-record research that could require labor-intensive handwritten-deed searches, or waiting to tack on legal review to the consultants’ engineering work so the county avoids duplicative expense. The board directed staff to continue coordinating, discuss budgetary implications in work sessions, and defer substantial legal expenditure until the engineering record is more complete unless early legal findings become necessary.
Messenger also offered to append an executive session to discuss title questions if the board determined the matter warranted confidential legal deliberation. No executive session was scheduled at that meeting; staff and counsel were instructed to report back with cost estimates and proposed scope for any legal research.
