The Gilpin County Board of Commissioners voted to continue indefinitely a petition to vacate a 30-foot strip of roadway in Rollinsville after extended discussion about infrastructure and legal uncertainties.
At the hearing, county staff confirmed the 30-foot strip is dedicated county right-of-way and would be split between adjacent lots if vacated. Commissioners and staff raised multiple concerns that prompted the decision to delay a final vote: whether a passenger-rail station remains likely at the site, limits on septic permits and firefighting water in Rollinsville, the presence of a buried cistern and county leach field near the maintenance shop, and unresolved title and platting inconsistencies identified in the county’s GIS review.
County planning and engineering consultants are actively studying Rollinsville station siting and utility extension; staff said vacating the right-of-way would extinguish county interest in the parcel and that Timberline (a local interest referenced by staff) has expressed opposition to new commercial development because of local water constraints. The county attorney advised the board that site-specific title research can be costly and suggested deferring deep legal work until the engineering study produces a clearer record; commissioners asked staff to bring cost estimates and to include the matter in upcoming work sessions.
A motion to continue Resolution BLP 25-2 (vacating right, title and interest in Third Avenue with a 30-foot right-of-way) was made, seconded and carried by voice vote. The public hearing was closed and the item tabled with direction for staff to gather further information and coordinate with the county attorney about next steps.
The board emphasized that continuing the item is intended to avoid harming applicants (by preserving the option to reapply without additional fee when the matter is brought back) while the county develops better mapping and title information. No final decision on the vacate was made; the county will revisit the petition after additional engineering and title work are completed.
