The Village Council on Jan. 21 approved a rezoning that will allow a single‑family home on a 0.34‑acre triangular parcel at 4741 Broadway West.
Mary Gibbs, the village planning director, told the council the lot is about 12,000 square feet and that agricultural zoning required an acre to build; rezoning to single‑family residential would reduce the minimum lot area and make development feasible. Gibbs said staff reviewed the parcel against the comprehensive plan and recommended approval, noting the applicants have executed a 22.5‑foot drainage easement on the west side "so that we could...make sure we don't have flooding issues," and that the easement will be recorded and will not become effective until the zoning is approved.
The applicants' representative said the parcel includes an existing open drainage ditch and culverts that connect to the broader stormwater system and showed a conceptual house placement that, she said, would allow a roughly 2,300‑square‑foot elevated house. Gibbs and applicant representatives explained the lot currently lacks sewer and that any immediate construction would require a septic system and health‑department approval; the home would be required to hook up to sewer if and when sewer becomes available.
Council members asked about maintenance of the drainage easement and were told the village expects to assume maintenance of that 22.5‑foot strip if the rezoning is approved. After public testimony and council questions, the ordinance passed on second reading by unanimous roll‑call vote.
The council recorded no conditions beyond the accepted drainage easement; the village attorney outlined the quasi‑judicial procedures and reminded participants that the council's decision must rest on substantial competent evidence in the record. The council closed the hearing and voted to adopt Ordinance No. 2025‑15.
The approved rezoning will enable the owners to pursue a building permit subject to standard permitting and health‑department requirements for septic if sewer service is not yet available.
