The Deerfield Public Schools board voted Oct. 16 to approve a resolution authorizing a notice of remedy and ratifying an unpaid suspension; the board then moved to closed session to consider personnel matters.
Before the vote, the district’s legal adviser (Speaker 12) explained the constitutional and procedural standards the district applies to discipline: due process under the Fifth Amendment, progressive discipline, and seven 'just cause' tests that examine notice to employees, the applicability of employer rules, whether a thorough investigation occurred, whether evidence exists of misconduct, evenhanded application of rules, and whether consequences fit the seriousness of the offense and the employee’s record. The adviser said discussing specific incident details in open session would be "wholly inappropriate."
The board then made and carried the motion to approve the resolution by roll call. The clerk read 'Aye' votes and announced the motion carried. After that roll call the board voted to adjourn into closed session to discuss appointment, employment, discipline and related personnel matters.
