The Town of Loxahatchee Groves prevailed on a code-enforcement violation alleging unpermitted earthmoving, an unpermitted pole barn and tree clearing at 2241 A Road in case CE25-56. At a Feb. 3 hearing, the magistrate reviewed town photographs, a property-history aerial and testimony from code enforcement staff and granted the town's requested relief.
Town code enforcement presented evidence that the parcel, zoned vacant, had its topography altered, trees cleared without a mitigation permit and a pole barn constructed without permits. The town requested that respondents be given 30 days to apply for required permits and 60 days for permit issuance, and proposed a $250-per-day fine for continued noncompliance plus administrative costs of $234.05.
Special Magistrate Amity Barnard found respondents in violation of multiple ULDC sections and the Florida Building Code, and ordered that the respondents apply for required permits on or before March 2, 2026 and have required permits issued on or before April 2, 2026. Barnard warned that daily fines of $250 would be assessed for each day the violations continued after the stated deadlines and set a fine-assessment hearing for May 4, 2026 if noncompliance persists.
The town will receive an order reflecting the ruling and respondents were advised to work with permit staff to obtain the tree-mitigation and building permits the magistrate required.
