Special Magistrate Amity Barnard authorized the Town of Loxahatchee Groves on Feb. 3 to proceed with foreclosure in three enforcement matters tied to 3138 A Road after hearing testimony that liens had been recorded and remained unpaid for more than 90 days.
Town code representative Diana Thomas summarized the three lien totals through Feb. 2, 2026 as $205,468.55, $178,700 and $372,234.05 and testified that each lien continued to accrue daily penalties. Thomas told the magistrate the liens remained unpaid and were recorded in the public record; the magistrate reviewed recording dates and the town's evidence before granting foreclosure authorization in each matter.
Barnard said the authorization was ministerial once the statutory criteria were met and that the authorization would permit the town to pursue foreclosure but did not itself begin foreclosure. The magistrate signed orders granting the town authorization to proceed; the town will receive the signed orders by mail and may pursue the next statutory steps if the liens remain unpaid.
The magistrate noted the town could continue working with respondents toward compliance and that foreclosure authorization does not preclude remediation efforts.
