Residents ask Cave Creek to pause patent activations on Glory Road

At the start of the Feb. 3 meeting, a resident urged the Town of Cave Creek to pause activation of patents along Glory Road until town staff completes additional discussion and survey work.

A public commenter asked the council to put the patents on hold, citing potential legal implications and the difficulty of undoing activations once completed. He also asked that Resolution 2025‑25 — an extension to 32nd Street referenced during public comment — be rescinded, saying most neighborhood residents oppose that extension and prefer town maintenance of a blocked section on 36th Street.

“We are concerned that activation of the patents have the potential for legal implications,” the commenter said, and requested council delay activation while staff finishes surveying property edges. Earlier in the meeting, the town manager had announced survey work was underway to show property edges versus patent lines and said staff would bring residents back to a meeting to discuss options.

A councilmember asked a procedural question about whether meetings with prospective candidates would comply with open meeting law if four or more sitting council members attend; the mayor said those gatherings would be posted. David Phelps, another resident, announced an upcoming community meeting related to preservation and current events and said invitations to elected and appointed officials were being arranged.

Town staff signaled they are working with Glory Road residents to find options, and that survey work should clarify property edges prior to any further formal council action.
