The City of Margate Development Review Committee on Jan. 27 granted a conditional approval for a 15‑unit townhouse site plan at Malibu Gardens, 508–512 Malaluca Drive, but asked the applicant to resolve several technical comments before final stamping.
Senior planner Andrew (first introduced as Andrew) told the meeting the property is in an R‑3 multifamily district and that the proposed multifamily use is permitted by right, meaning staff review can approve the plan once comments are addressed. The petitioners — Michael Garrison and James Santani, representing 512 Malaluca LLC and agent Adelino Rivera — had requested clarity on schedule and the next steps so they could proceed with construction documents.
During discussion, Paula from engineering said staff needs a clear backup document for wastewater capacity that “has that statement, that has the evaluation” and explains the impact on the lift station and capacity findings. Staff also flagged a wording problem in the plans that described the city wastewater system as “potable,” and asked the team to correct the language and attach the supporting documentation in project docs.
Other technical items raised included plan sheet mismatches, landscape and tree conditions, crosswalk alignment, and a surface‑water licensing requirement that will require outreach to Broward County before the final engineering permit can be issued. Staff and the applicant agreed most comments are technical; several were described as “info‑only,” while unresolved items must be addressed as resubmittals. Andrew advised the applicant to resubmit corrected files using identical file names so the city’s versioning recognizes them as corrections.
With those conditions, Andrew stated the committee would grant a conditional approval so the applicant may proceed with building‑department pre‑plan review and preparation of construction documents. There was no roll‑call vote on the record; staff characterized the action as staff‑level approval contingent on resolving comments in project docs and obtaining required county documentation where specified.
Next steps: the applicant will upload backup wastewater documentation, update marked plan sheets, coordinate any required permits with Broward County, and complete project‑docs resubmittals for staff verification and final stamping.
