Santaquin council adopts rezoning and multiple code amendments including ADU parking and retaining-wall measurement

The Santaquin City Council approved a series of resolutions and ordinances at its Feb. 3 meeting, adopting changes that city staff described as technical fixes, process clarifications and a rezone of a downtown block.

Resolution ratification: Council ratified a minor modification to the Sunset Ridge development agreement (referred to in the meeting as resolution '12-Dash03-Dash2025') to allow a developer to move a pipe and receive potential reimbursement should NRCS (Natural Resource Conservation Service) funds become available. Community development staff emphasized the city would not assume added liability if NRCS funds do not materialize; the motion to ratify was made by a councilmember and seconded and passed by voice vote.

Central Business District rezone: After staff and planning-commission briefing, the council adopted an ordinance (recorded in the meeting as ordinance number '2 0 1 20 26') that rezones approximately 3.7 acres from Central Business District to Main Street Residential and about 20.4 acres from Central Business District to Main Street Commercial. Staff said planning commission reviewed the proposal, a public hearing was held, and around 120 mailed notices were sent to nearby property owners before council consideration. Councilmember (speaker 5) moved adoption; it was seconded by another councilmember and approved with multiple 'Aye' votes.

Code cleanups and state-alignment ordinances: The council approved a technical code amendment clarifying temporary-business-license durations by cross-referencing section 10.160.3 (intended to avoid conflicting generic 120-day language). Council also adopted an ordinance amending local code to align ADU parking requirements with recent Utah state legislation (cited in council remarks as affecting the number of required off-street parking spaces for accessory dwelling units). Staff described these as technical or required updates; both ordinances passed on motions and voice votes.

Retaining-wall measurement standard: Council adopted an ordinance changing how retaining walls are measured — from finished grade-to-top to footing-bottom-to-top — to conform to state code. Staff and a resident discussed whether privacy fences would be affected; staff clarified fences are not retaining walls though some masonry fences can function as such. Staff also explained a retaining wall requiring permit must be 4 feet or taller under the new state-based measurement rule.
