Box Elder council approves first reading of rezone, prelim/final plat and easement payment for Red Baron Subdivision

The Box Elder City Council on March 4 approved the first reading of an ordinance to rezone two lots in the Red Baron Subdivision from agriculture to highway service, approved a preliminary-and-final plat for those lots and authorized a permanent utility easement payment.
Planning and Zoning Director Harley Patton presented the rezone and the plat, saying, “This is the plat that goes with the rezone application … creating 2 additional lots in the Red Baron subdivision,” and noted public infrastructure at the site required a combined preliminary and final plat. Patton said the lots adjoin existing highway service–zoned parcels along Liberty Boulevard and that the rezone aligns the parcels with neighboring land uses.
Council moved and passed the ordinance 7-62 first reading (motion by Knight, second by Talich) by unanimous roll call. The council separately approved the preliminary and final plat with a stipulation that development engineering plan approval and acceptance of a surety bond by the city engineer’s office be completed before building permits are issued.
Staff also described a permanent waterline and access easement offered by property owners Larry and Margaret Jones that overlaps county highway easement areas but specifically covers utilities. Council approved recording the easement and authorized payment of $3,750 to the Joneses to acquire the permanent easement.
The approvals on March 4 were procedural and include conditions: the ordinance passed on first reading (further readings or publication requirements may apply under local code), and the plat approval is contingent on subsequent engineering plan approval and surety acceptance. No public comment for or against the rezone was received at the hearing.
The council’s next procedural steps are to complete statutory publication and any required subsequent readings for Ordinance 7-62 and to confirm the engineer’s acceptance of plans and surety before permits are issued for the new lots.
