Division of Insurance outlines parity enforcement, consumer and provider complaint channels; PDAB says it set first state upper payment limit

Commissioner Mike Conway and Tara Smith, behavioral health director at the Division of Insurance, told the committee how the state enforces mental health parity and how it is expanding proactive reviews.
Smith described parity measurement as a combination of quantitative treatment limitations (QTLs) such as visit limits and cost‑sharing and non‑quantitative treatment limitations (NQTLs) such as utilization management, network admission standards, and provider reimbursement methods. She said Colorado’s 2019 Behavioral Healthcare Coverage Modernization Act codified federal parity requirements and added annual carrier reporting that allows the division to review both QTL and NQTL submissions.
The division has focused on both retrospective enforcement (market conduct exams that secured refunds to consumers who were overcharged) and prospective review by examining carriers’ form filings and evidence of coverage before the plan year opens. Smith said the division launched a provider complaint portal to gather qualitative reports from providers about credentialing and participation barriers and to identify systemic patterns.
Commissioner Conway discussed the Prescription Drug Affordability Board (PDAB). Dr. Amy Gutierrez, PDAB chair (participating online), said the board issued an upper payment limit for the rheumatoid arthritis drug Enbrel, describing it as the first state action of this type. Conway noted PDAB is being litigated in court but said the board has acted consistent with legislative direction to evaluate affordability and take steps when drugs are not affordable for Coloradans.
Legislators asked how the division verifies refunds were distributed after enforcement actions; the commissioner said the division would confirm and report back. The division also described using annual filing review to catch issues before consumers are harmed and the range of enforcement tools available, including market conduct exams.
