Venice magistrate continues Neary code-enforcement case to May as probate proceeds

On Feb. 4, 2026, the City of Venice Code Enforcement Special Magistrate continued case CEBD24-00524 — concerning property associated with Mildred H. Neary — to the May 6, 2026 Code Enforcement Special Magistrate hearing after the city said the matter remains in probate.
Daniel P. Lewis, appearing for the City of Venice, told the magistrate the property owner died about 11 years ago and that the heirs have filed an amended petition seeking summary administration and a declaration of homestead to remove the property from probate. Lewis said the heirs' attorney, Mr. Mowery, anticipated an order granting that petition by the end of the month. Lewis said, “This will actually be pretty quick today,” before outlining the request for more time.
Lewis asked the magistrate to continue the matter for 90 days so the probate court can issue the expected homestead order and the heirs have time to obtain required permits. He explained a 30-day continuance would likely be insufficient even if the judge signs an order within a month because the extra time provides leeway to secure permits and complete any necessary work.
The Special Magistrate asked whether Mister Neri — an heir identified in the hearing record — wished to speak; no substantive comment was recorded. Based on the city's request the magistrate scheduled the case for the May 6, 2026 Code Enforcement Special Magistrate hearing. Staff also noted the next special magistrate session is scheduled for March 4, 2026, at 10 a.m.
The hearing was then adjourned.
