North Kingstown council approves sewer-abatement settlement, water-main work, CRMC recommendations and a package of appointments

The North Kingstown Town Council on Feb. 24 approved a series of routine and substantive measures: a sewer-assessment abatement tied to a settlement, coordination of a Post Road water-main replacement with a planned sidewalk project, inclusion of Conservation Commission recommendations in CRMC filings for two condominium redevelopments, tax-appeal settlements and a package of board appointments.

Sewer-assessment settlement: Town staff reported that Rear Land LLC filed an appeal involving property behind the Easy Stay on Post Road and that parties agreed to a revised assessment of $140,220. The town manager and solicitor told the council this settlement avoids costly litigation; the council approved the abatement, including $122,000 in late-fee forgiveness as presented by staff.

Infrastructure coordination: Council members discussed potential business impacts on Post Road from a planned sidewalk project. Alan (staff/engineer) described an inline water-main replacement approach intended to minimize disruption while the sidewalk work proceeds; the town will time the water-main replacement with RIDOT and sidewalk work to avoid re-digging newly installed sidewalk. The council voted to proceed as presented.

Conservation Commission recommendations and CRMC filings: After public testimony supporting the Conservation Commission's conditions, the council voted to incorporate the commission's recommendations into filings to the Coastal Resources Management Council for both the schoolhouse and old theater condominium applications. Town staff reported the developer did not oppose the recommendations.

Tax appeals and property settlement: The council approved settlement terms recommended by the solicitor and tax assessor for several tax appeals to avoid further litigation costs. For the Scalabrini property (purchased in 2021 for $4,000,000), the council approved an assessed value of $5,700,000 as a settlement figure, lower than the town's prior $6,000,000 assessment.

Noise mitigation request: The planning commission's request that the town send a memorandum to RIDOT asking for a Route 403 noise-mitigation analysis passed unanimously; council members described the move as a first step since the land adjacent to the highway is privately held.

Appointments and boards: The council approved multiple appointments and reappointments (Conservation Commission, Conservation/Harbor/Advisory boards), re-advertised vacancies for several commissions (personnel board, building code of appeals, zoning board alternate seats) and reappointed Peter Morgan as tree warden. The council also appointed Captain John McCoy as the appraiser of dog damages through April 1, 2026, and approved Elise Welch (owner, Press Restaurant) for a business/property representative seat.

Other business: Staff reported progress and timing on major capital projects including the public-safety complex schematic design and upcoming budget schedule; the planning department demonstrated a new online GIS system (CAI Technologies) that staff said will go live soon and links to the assessor database.
