At the end of its Feb. 3 work session the Doña Ana County Board of County Commissioners voted to enter a closed session to consult with legal counsel on pending or threatened litigation related to a flood joint‑powers agreement.
Chair moved that the board "convene in closed session pursuant to attorney‑client privilege, [to] discuss pending or threatened litigation related to the flood joint powers agreement as authorized by the Open Meetings Act section 10‑15‑1(H)(7) of NMSA 1978." The motion was seconded by Commissioner Sheldrow Hernandez and a roll call vote recorded "Yes" from Commissioner Sheldrow Hernandez, Commissioner Chaparro, Vice Chair Ramirez and Chair Sanchez. The board recessed into closed session at 11:08 a.m., returned to open session at 11:44 a.m., and the chair stated that the only items discussed in closed session were those noted in the motion. The meeting was adjourned at 11:44 a.m.
No additional substantive actions or votes were recorded in open session after the closed meeting.
