Austin staff previews proposed payment-plan for BSC penalties; no action taken

City staff presented a draft payment-plan agreement for penalties assessed through Building and Standards Commission proceedings and sought feedback from commissioners on Jan. 8.
James Gondellas, a code review analyst, said the draft borrows elements from existing administrative-hearing installment agreements and settlement tools and is intended for cases where no penalty relief was granted. "We set out to draft a new policy tailored for BSC matters," Gondellas said. The proposed agreement would allow owners who cannot pay a penalty balance in full to enter a structured installment plan.
Commissioners and counsel asked how a timely payment would be defined, whether interest would accrue and how defaults would be handled. Counsel explained the draft leaves a monthly due‑date blank so the first payment date can be chosen and that the draft treats a single missed payment as a default that could trigger collections and referral to law department for debt recovery. Commissioners asked whether the plan would be broadly available and whether it would change how the commission assesses penalties; staff said the policy would not replace penalty relief proceedings and would apply only where no offset or relief was granted.
Because the presentation was for discussion only, the commission did not take a vote; commissioners signaled support to send the draft to the executive team for further consideration and implementation planning.
