Commission endorses expedited review for "attainable housing" under AB 540

Washoe County’s Planning Commission on Feb. 3 voted unanimously to recommend a development-code amendment establishing expedited review pathways for projects meeting the state’s "attainable housing" definitions and qualifying tiers under AB 540.

Senior planner Kat Oakley said housing affordability is a regional challenge and that housing-cost burden among renters in the region is currently about 50.5 percent. She summarized AB 540’s shift from the term "affordable" to "attainable" with five tiers extending up to 150 percent of area median income and explained two primary code changes: an administrative-review permit option for projects that have received funding from the Nevada attainable housing account (which would avoid a public hearing while retaining notice and appeal rights) and an expedited coordination process for tier-1 through tier-5 projects that would allow applicants to request a staff liaison to help coordinate reviews across county and partner agencies.

Oakley said applicants using the administrative pathway would need to provide evidence of funding from the state account; projects not receiving state funds could still request prioritized coordination and a staff liaison but would be required to document mechanisms to ensure the units remain restricted to the intended income tiers.

Pat Davidson spoke in support, praising staff for including safeguards, noting that administrative review includes notice to affected owners and appeal rights, and urging that staff-liaison access be available even for projects that do not receive state funding.

The commission moved to recommend initiation of WDCA250012 and authorize the chair to sign a forwarding resolution; the motion carried unanimously.
