The Newberry County Board of Zoning Appeals granted a variance on Feb. 3 allowing an existing 10-by-10 storage building at 1197 Newberry Shores Drive to remain at a reduced side setback.
Staff and the owner, Donald Beason, told the board the structure was present when he purchased the property and that the building had been in place for years. Neighbor Gary Ginn and counsel Ben Bruner questioned whether the shed had been moved since purchase and supplied dated photographs that Bruner said showed the building in a different location; Bruner argued the structure could be moved to comply with the 7-foot setback if necessary.
Beason said the 10x10 storage building "was there when I bought the property" and described water runoff issues and site constraints. Bruner told the board a 2013 timestamped photograph suggested movement of some buildings and urged caution about extending nonconformity.
The board reviewed the five findings under section 153.052(c). Members who examined the record agreed the storage building was existing and that granting the variance would not establish a new use or change zoning boundaries. A motion to grant the variance carried and the board announced the variance had been granted. The transcript does not record a detailed roll-call tally for the final motion.
