Laura Lee Patton, finance director for the City of Box Elder, presented a staff recommendation on a pre-construction floodplain development permit and associated grading permit for 520 and 532 Line Road (Lots 5–7 and 9 of Block 2, McGriff Add Subdivision). Patton said the applicant submitted a pre-construction elevation certificate and that staff and the city engineer were comfortable recommending approval of the floodplain development permit to allow the applicant to pursue future development.
Patton explained that the permit is pre-construction: the developer would still be required to provide an as-built elevation certificate before receiving a certificate of occupancy once a structure is built. "This pre construction floodplain development permit would allow them to get a building permit," Patton said, adding the applicant currently has no concrete building plans but is preparing the site for future development.
A motion to approve the floodplain development permit and forward the recommendation to city council was made and seconded; the commission approved the motion by unanimous roll-call vote. The recommendation to council is advisory; final regulatory approvals and issuance of any building permits will be contingent on submittal of required as-built documentation and compliance with applicable conditions.
Key details: The permit request is for grading across the floodplain on the subject parcels and is intended to allow future development. Staff noted the requirement for an as-built elevation certificate prior to a certificate of occupancy and that the permit permits building-permit processing once the as-built documentation is provided.
