Commission recommends vacating Coyote Corner Phase 2 plat so property can be sold as farmland

Zoning staff asked the Lee County Regional Planning Commission to recommend vacating the final plat for Coyote Corner Phase 2 so the estate can sell the land as agricultural property. The petition, filed by the estate of Richard Fluck, follows a map amendment that the Lee County Board approved on Jan. 22 to return the lots to agricultural zoning.
Staff said Phase 2 contains undeveloped lots with no installed utilities, roads or private water, and that returning the area to agricultural zoning would allow the owner to market the property as farmland without leaving small platted lots in place. "Nothing has been developed at all in Phase 2," staff said; "you can't even really get into phase 2 because the roads haven't been constructed."
Commissioners asked whether any portion of the subdivision (an unbuilt roadway) constituted a right-of-way or easement that would require separate action; staff said the west-side unbuilt roadway is considered right-of-way and could not be altered unless separately vacated. After discussion, Commissioner (Speaker 3) moved to recommend vacating the plat to the county board; Commissioner (Speaker 4) seconded and the motion carried by voice vote with no opposing votes recorded in the transcript.
The recommendation will be forwarded to the Lee County Board, which must issue a resolution and the owner will then record that resolution with the recorder's office to effect the de-platting.
