Beaver City officials conditionally approved a variance request from Randy and Tracy Purcell to reduce the required side setback at 435 North 200 East from 8 feet to 5 feet, but asked the applicants to confirm county mapping or provide a formal survey before construction.
The Purcells’ application, presented at the meeting, seeks an attached garage that would encroach on the south side setback. "8 feet is what the setback requires, and she's asking for a 5 foot setback instead of an 8," Speaker 1 said during the discussion. The panel reviewed aerial photos and site drawings submitted with the application and discussed existing features including a retaining wall and a large tree near the property line.
Following an informal review of the county GIS overlay, staff and commissioners said the county map indicates the Purcells may already have sufficient room on the south side and that a variance might not be necessary if the county's mapping is accurate. "If it's acceptable with them, then acceptable to us," Speaker 2 moved, urging the applicant to check with county mapping staff; Speaker 1 seconded the motion and the body approved it.
City members urged the Purcells to obtain a survey or county confirmation to avoid future disputes. Speaker 1 recommended the applicants "talk to Kevin Wicker of the county" in the recorder's office, who handles county mapping but is not a licensed surveyor. The panel also noted practical implications if the garage is attached: the home's electrical meter would likely need to be relocated to the new side of the house and applicants should coordinate with the electrical department.
The panel recorded no formal objection from neighbors during the meeting. The Purcells agreed to follow up with county staff and return with any clarifying survey or documentation if needed. The body then closed the hearing and adjourned.
Next steps: the Purcells will contact county mapping (recorder's office) to confirm lines or obtain a survey, coordinate any necessary meter relocation with the electrical department, and return to city staff if additional approvals are required.
