Rufus Leon Waters applied for a 1.35-acre variance to Section 14-18, which sets a minimum size of two acres for daycare facilities in the applicable zoning. The board voted unanimously to grant the variance and added a condition requiring a fence along Highway 67 outside of Georgia Department of Transportation right-of-way to deter children from running toward the highway.
The applicant’s agent (speaker 13) provided an updated site plan and said she had an email from GDOT saying the department would not require work in the right-of-way for the entry and exit shown on the plan. The agent described the proposed daycare’s scale: "We based the square footage off of roughly 50 children," she said, and noted the facility will include playground fencing, locked entry doors, and a security camera system.
Board members added the fence requirement as a condition and left specific fencing material and details to be determined by county staff. With that condition in place the board approved the variance unanimously.
The variance was recorded as granted during the meeting; the transcript indicates county staff will enforce conditions and ensure compliance as part of the permitting process.
