Planning commission recommends approval of multiple fireworks licenses, discusses insurance and state sale periods

Planner Michelle Clavadach presented three fireworks-license items and staff recommendations for approval.

For a temporary license, Main Street Fireworks proposed operating at the Flying J Truck Stop; staff noted the state-defined retail sales window of June 27–July 5 with a 15-day storage period before and after (June 14–July 20). City rules limit temporary class licenses to six per year and restrict a single owner or legal entity to holding no more than two such licenses within city limits. The commission voted to recommend council approval.

For an annual license, Big Fireworks LLC at 4501 South I‑90 Service Road seeks an annual permit that allows wholesale sales year-round and retail sales during specific state-defined periods (May 1–Aug. 31 and Dec. 26–Jan. 2). Staff noted the annual holder must operate from a permanent structure and obtain appropriate state sales tax and state fire-marshal licenses. Commissioners asked about insurance minimums; staff and counsel review indicate a $2,000,000 total minimum (with per-occurrence figures discussed in the record). The commission voted to recommend approval.

Patriot Fireworks (temporary license at 520 North Ellsworth Road) was presented with the same temporary sales window and storage schedule; staff recommended approval and the commission voted to recommend council approval.

All three recommendations passed on roll-call votes. Commissioners offered routine member input (none substantive) and the meeting adjourned.
