Planning commission approves micro‑entrepreneurship conditional use for RM7 lots

The Grantsville Planning Commission on Feb. 3 approved a new conditional‑use allowance intended to help residents run small, home‑based microenterprises within the RM7 zone while limiting neighborhood impacts. The measure sets a 150‑foot minimum frontage for eligible lots and operational limits intended to cap customer visits.

Phil, the city’s Community Development director, told the commission the proposal aims to thread a middle ground between a traditional home occupation and full retail, and to provide “a reasonable balance between allowing these kinds of uses in some areas and not allowing it just generally on every lot.” He said staff clarified the code language and reduced an originally proposed 200‑foot frontage minimum to 150 feet.

During public comment Gary Pinkham urged clearer, enforceable language in the code and raised what he described as contradictory limits in the staff report: “the code right now is contradictory,” he said, citing inconsistent employee and operational limits and warning that permissive 'permitted' language can prevent the city from imposing conditions such as hours, lighting or fencing.

Commissioners discussed the role of conditional use review versus performance standards and noted enforcement pathways if neighbors file complaints. The commission also discussed an operational guideline that anticipates two to four customer visits per hour as a typical upper bound; commissioners said higher levels of activity would likely prompt code enforcement or a business to relocate to a commercial storefront.

A motion to approve the micro‑entrepreneurship conditional use passed on a voice vote. The commission closed the item with a direction that staff can revisit the standard if it proves problematic.

The ordinance language will next be forwarded to the City Council for any additional steps required by Grantsville’s adoption process.
