A representative for the Mall Lake property owners told the North Miami Beach commission Dec. 16 that annexation documents dating to 1957 and a related final judgment vest the owners with broad development rights and that the city has resisted implementing them.
Scott Wiers said the city located the annexation documents this past July after a decade of litigation and that the documents "vest the owners with rights to dredge, fill, grade, and develop the lake." He said court questioning during recent hearings suggested the city's position was at risk and urged the commission to convene a public workshop within 45–60 days to review the annexation agreement, final judgment and the proposal before the commission.
City staff and special counsel reminded the commission that a separate executive-session history exists on the matter and said the city has a different interpretation. The city attorney noted that special counsel and the city hold a different view and urged the public to consider both sides.
What happens next: Wiers said he will present documents and hearing transcripts at future meetings and requested a publicly noticed workshop; commissioners did not set a specific date at the meeting but staff indicated they would coordinate follow-up engagement.
