The Board of Zoning Adjustment on Monday approved two variances for 2085 Old Moralson Highway to resolve conflicts with current fire-code and zoning standards. Planning staff told commissioners the site is zoned R-2 and includes an existing single-family home, a storm cellar and a storage building at the rear of the lot.
Staff said the request comprises two variances: a reduced side setback from 6 feet to 3 feet 4 inches and a 5-foot encroachment of a rear storage building into a utility easement. Staff said both Callmate Corp and the city fire marshal have reviewed the request and were in concurrence with granting the waivers. Staff also noted many structures on the lot predate annexation, and a lot split will be required to make both sides conform under current zoning.
The applicant identified herself as “Mary Tina’s, but I go by Mandy” and said the adjacent house and pool were part of her family home; “My parents built that original structure in, I think, 1938,” she said, and the parcel sought for variance was formerly a Forestry Commission building the family bought about 25–30 years ago. She said the family seeks to sell the larger house and that granting the variances would facilitate appropriate use and potential redevelopment.
After no speakers registered opposition, a commissioner moved to approve the variances and another seconded. The commission voted in favor; no opposed votes were recorded. Staff had proposed six conditions as part of the variance approval; those conditions remain attached to the approval.
The chair adjourned the BZA portion of the meeting and returned the matter to the planning commission process for any additional review required by city procedures.
