City Council on Sept. 12 approved a zoning text amendment to allow private educational facilities as a special‑use in the LB‑2 limited commercial neighborhood (Arts District), and separately approved a specific application for Bender Music Conservatory to operate at 106 Bacon Avenue.
Planning staff (Miss Griffin) told council the text amendment (PCR 24016) updates section 24‑255.4 to allow for‑profit and nonprofit private educational facilities that draw students from the public, in keeping with the LB‑2 mixed‑use designation and existing allowances for studios and live‑work uses. The planning commission recommended approval and staff agreed.
On the Bender Music Conservatory application (PCR 24017), Griffin described site‑specific conditions recommended by staff and the planning commission: recitals shall not be held on site and classes or rehearsals are limited to no more than four non‑familial students at a time because the applicant and family will reside on the second floor and classes will be held on the first floor. "If you have any questions, I'm happy to answer them," Griffin said; no public speakers objected during the hearing.
Council members noted the use fits the Arts District and adds vibrancy and pedestrian activity. A motion to approve PCR 24017 with the stated conditions passed unanimously.
