TWC accepts staff recommendations on wage claim and UI dockets; rehearing ordered in one unemployment case

The Texas Workforce Commission moved through docketed wage claim and unemployment insurance business and accepted staff recommendations on the remaining cases, with commissioners recording specific dissents on short-form lists.

On wage claims, Commissioner Connacht said no wage claim cases were pulled for additional discussion; he moved to accept staff recommendations for the remaining cases on docket 5. A colleague seconded while noting which cases appeared on the wage claim short-form dissent list; the motion passed with the exception noted.

Under unemployment insurance (UI) cases, commissioners discussed multiple appeals. In case 3674433, a commissioner said the record should be developed further to determine when the claimant reported to the employer and recommended a rehearing; another commissioner said the claimant missed the AT hearing for good cause while caring for a premature newborn and argued the employer gave conflicting directions about reporting times. The chair and other members agreed to rehear the case to clarify reporting-time facts.

Several other UI cases on docket 5 prompted competing views about misconduct, timeliness and evidentiary sufficiency, with commissioners taking positions for affirming, reversing, or rehearing depending on the case. Staff provided short-form dissent lists for UI cases, and Commissioner Connacht moved to accept staff recommendations on the remaining UI cases; the motion passed with the exceptions noted on the short-form list.

The commission concluded its business on agenda items 3–8 and resumed the remainder of the agenda.
