The Omaha Planning Board on Aug. 20 voted 7–0 to layover a conditional-use permit (CUP) request for an accessory dwelling unit (ADU) at 20780 Timberlane Drive to allow the applicant and the Skyline Ranches Homeowners Association to meet.
Applicant Michael Krueger said he plans to remove a detached two-car garage and replace it with a detached ADU so his parents could return to live on the property. Kathleen Foster, an attorney representing the Skyline Ranches property owners association, said the association learned of the project late and that neighborhood covenants restrict single-family lots; she asked for a layover so the HOA and applicant could confer. "At a minimum this be laid over, so we have an opportunity to talk to mister Krueger," Foster said.
Eric England, planning staff, told the board the city’s ADU code is the governing standard for the CUP and that the city is not a party to private neighborhood covenants. "The city is not a party to neighborhood covenants," England said, and added that if covenants prohibit an ADU, that could create a private legal issue separate from the city's process. Staff recommended approval subject to three conditions but supported a layover if the board wanted more time for neighbor conversations. The board voted to layover to allow those discussions.
Why it matters: ADUs remain a point of friction in neighborhoods with restrictive covenants; the board’s layover aims to encourage communication while preserving the applicant’s ability to pursue the city process if covenants do not preclude the ADU.
