Defiance council adopts MS4‑driven changes to illicit discharge and stormwater rules

The Defiance City Council on Jan. 27 adopted two ordinances to update the city’s stormwater and illicit‑discharge regulations following an MS4 audit and to help preserve the city’s NPDES permit.
City attorney/administrator O'Donnell told council the federal Clean Water Act and implementing MS4 requirements prompted the recommended changes. "One of them is in our illicit discharge ordinance," he said, asking the council to codify language that would limit allowable discharges from firefighting activities to those other than planned training events and to clarify when pool owners may discharge treated pool water to storm infrastructure.
O'Donnell said the changes also remove some exemptions in Title 11 (stormwater management and drainage) and clarify when post‑construction stormwater plans are required for new developments, including potential bond or escrow requirements if plans are not followed.
Council members discussed enforcement. The MS4 coordinator, Jen English, was named as the staff person responsible for enforcement and investigations; O'Donnell and others described enforcement as largely complaint‑driven. "If the neighbor sees something, they're gonna call it in and then Miss English is gonna go check it out," O'Donnell said.
The council suspended the rule and adopted both ordinances by roll call. City officials said the changes are necessary to meet audit findings and to maintain compliance with the city's NPDES permit.
Council recorded the action and the ordinances were adopted that evening; staff said they will follow up on implementation details and any enforcement cases that arise.
