Planning Commission approves Cane Harbor Bay replat and grants sidewalk waiver for Laguna Shores

Andrew Dimas of Development Services read the consent agenda and presented item 2, a replat of Cane Harbor Bay (Lots 30R and 32R, Block 38), 0.6 acres, and recommended approval after staff and technical review. "Staff has reviewed the plat ... and deemed that it is compliant with the Texas local government code as well as the Unified Development Code," Dimas said. The replat was approved by voice vote as part of the consent agenda.
Dimas also presented two sister projects (items 3 and 4): a request for a sidewalk construction waiver under Unified Development Code section 3.85 for a corner lot at Rex Lane and Laguna Shores Road, and the associated replat. He told commissioners the waiver was requested because the proposed sidewalk would connect to no existing sidewalk network: "So the nearest sidewalk that it would connect to is approximately 4,000 linear feet away...it's coming from nowhere and it's going nowhere," Dimas said. Staff recommended approval of the waiver on the grounds that it would not be a detriment to public health or safety and would not negatively affect adjacent properties.
Commissioners questioned access to nearby bus stops and how pedestrians currently reach transit without sidewalks. Dimas said pedestrians likely walk in roadside ditches and that staff pursues grant opportunities and coordination with the Metropolitan Planning Organization and the RTA for future connections. Commissioners also asked whether requiring immediate sidewalk construction would create redundancy if the city later widened a roadway through a bond project; staff said they try to avoid requiring construction where a planned bond project would require rework.
After questions, a commissioner moved to approve items 3 and 4 as presented by Development Services; the motion was seconded and approved by voice vote.
