Berks County approves TEFRA resolution allowing bond refinancing for Lutheran Senior Services

Scott Waller, bond counsel representing Lutheran Senior Services, told the Berks County Board of Commissioners that the county was holding a TEFRA hearing required under federal tax law before a Missouri conduit issuer could proceed with tax‑exempt bond financing for projects that include the Lutheran Home at Topton.
Waller said the TEFRA process requires (1) published notice, (2) a public hearing and (3) local governmental approval and emphasized the county would not bear financial or other liability related to the issuance. "It is just a federal tax law requirement," he said, describing the hearing as a procedural step and welcoming any public comments submitted under the county's public comment rules.
No members of the public registered comments on the bond item. Following Waller's presentation, a commissioner moved to approve the issuance of bonds to refinance the identified projects; the motion was seconded and carried by voice vote.
The board's action allows county staff to adopt a resolution consenting to the issuance as required by the TEFRA process. Officials said the county's consent does not create county liability and that separate conduit issuers will manage the bond sale and related debt service. The recorded motion and outcome were read into the minutes and the board moved on to subsequent agenda items.
