Summary
Commission staff updated the Planning and Traffic Commission on ongoing legal actions related to a proposed data center; a resident during public comment warned the project would "put a drain on our water," and staff noted multiple lawsuits are publicly filed and available on the city website.
Commission staff provided an update Jan. 28 on legal actions concerning a proposed data center that has drawn public attention and litigation in multiple forums.
Tom, speaking during the reports portion of the meeting, told commissioners the city has posted materials and that the city filed an action against the county and the developer in state court. He also said the applicant developer filed a federal suit against the city and four individuals. "The city has filed an action against the county and the developer, which is in state court," Tom said, and added that the developer had filed suit in federal court and against four individuals; he said the paperwork is available on the city's website.
Tom also said a question challenging Brown Act procedures will appear on an upcoming city council agenda. The staff update emphasized that the legal filings and related documents are public and available for review.
During public comment a resident voiced opposition to the data center's location, saying it would strain local water resources and pointing to anticipated cuts to California's Colorado River allocations. "It's gonna put a drain on our water," the resident said, and urged locating such facilities on Bureau of Land Management property rather than where people live.
The commission did not take regulatory action on the data center during the meeting; staff directed members to posted legal documents and forthcoming council agenda items for details. The city—s legal process continues in state and federal courts according to staff.
Next steps: the Brown Act challenge will be considered on the city council agenda as noted by staff; members and the public may review court filings posted to the city's website for further information.
