The City Council on March 17 denied an appeal and upheld the Planning and Land Use Management (PLUM) Committee recommendation to allow a two-lot split of a property on Urban Street rather than the three lots the owner requested.
The property owner said the subdivision had been approved by a subdivision committee and urged the council to allow three lots, noting he had collected 88 signatures in support. Opponents including neighborhood representatives and Walt Sadler said the local advisory bodies, the Board of Zoning Appeals and PLUM had unanimously recommended a two-lot division and urged the council to honor those findings.
Councilwoman Chick told colleagues the issue was not merely one neighbor opposing but “about good planning” and argued that a two-lot solution better respects the surrounding zoning and community character. A planning representative (identified in the hearing) confirmed that a two-lot division could be done as a flag lot without private-street improvements and that a two-lot split would not require a full street improvement.
The council prepared the roll and tabulated the vote; the clerk recorded 10 ayes and the item was approved consistent with the PLUM recommendation.
The council’s action denies the appellant’s request for three lots and affirms the local advisory and zoning bodies’ findings. The ordinance or related approvals were held on the desk where a higher vote threshold is required for first reading items.
