Delegate Simon asked the subcommittee to carry House Bill 160 to the 2027 session under Rule 22 so the FOIA Council can spend additional time reviewing the proposal. He said the FOIA Council, which he chairs, prefers to have draft language to examine and that the council's review would benefit the bill's development.
A motion to carry HB 160 to the 2027 session with a letter referring it to the FOIA Council was made, seconded, and approved by voice vote; the chair announced the bill would be carried over to 2027 with that referral. Earlier in the meeting the chair granted a request from Delegate Cohen to allow HB 463 to "go by for the day," which the panel approved by voice vote.
Delegate Simon described HB 160 as arising from caucus leadership and said referring the bill to the FOIA Council would allow subject‑matter expertise to improve the text before potential reintroduction. The subcommittee took no further action on HB 160 at this meeting; it will be eligible for consideration in the 2027 session after the referral.
