Brentwood zoning board approves two accessory structures with conditions; one member recuses

The Brentwood Board of Zoning Appeals approved two accessory-structure requests at its Jan. 20 meeting, voting to grant conditional permission for projects at 1401 Bowman Lane and 772 Bath Oak Drive.
Staff presented the first request, BZA-2511003, for a 720-square-foot detached structure on a lot in the Brentwood South subdivision (R-2 zoning). Allison, speaking for staff, said the structure is partially constructed and that a stop-work order has been issued because the building was constructed at the side of the house rather than in the rear buildable area required by code. "There are 4 conditions of approval and staff recommends approval of the detached accessory structure subject to all building codes and staff notes," Allison said.
The property owner, identified in the record as Mister Sujati, told the board he revised the facade to brick and would move the partially built structure to the correct location behind the house. A board member who said they live on the same street recused themself, calling out concerns about "the perception of financial influence, personal influence." The board then moved and seconded the approval and recorded ayes.
The second approved item, BZA-2512-002, was a request in Wetstone Subdivision Phase 5 (Lot 125) at 772 Bath Oak Drive for a 507-square-foot detached accessory structure. Don Borgeson of D2 Pools, who represented the applicant, provided renderings and said the design includes both an enclosed "living" (air-conditioned) area and an outdoor kitchen; he emphasized that it "is not intended for residency" and that the space is strictly for entertainment. Board members asked about interior features (sink, refrigerator, cabinets) and confirmed there is no laundry area.
Allison said staff recommended approval for the Bath Oak Drive structure as well, subject to four conditions and compliance with building codes. The board moved, seconded and voted in favor.
In other business, Allison told the board that Lisa Rothman is no longer on the BZA; the board will nominate a new vice chair at its next meeting, scheduled for Tuesday, Feb. 17. A motion to adjourn was then made and seconded, and the meeting ended.
The approvals were conditional; the record notes a stop-work order on the Bowman Lane structure and that both approvals are subject to the stated four conditions and applicable building codes.
