DEP outlines PFAS testing expansion and biosolids review after EPA guidance

Lawmakers asked about DEP's current PFAS testing capacity and how the department will respond to EPA guidance on biosolids. Acting Secretary Jessica Shirley said the General Assembly appropriated funding last year to expand DEP's lab testing capacity; DEP purchased equipment and is filling positions needed to run the tests after the department's maximum contaminant level (MCL) rule went into effect. Shirley said EPA later finalized a more stringent drinking-water MCL, and DEP is evaluating that federal guidance.
On biosolids, Shirley said EPA issued a PFAS biosolids risk assessment late last year; DEP is assembling a team of scientists and academic partners to review biosolids issues, including PFAS, heavy metals and pharmaceuticals, and to inform permit conditions. She said DEP currently has more than 70 investigations involving PFAS that include soil and groundwater testing and that drinking-water testing and remedial action are handled through the environmental cleanup and brownfields programs.
Shirley told legislators DEP will coordinate with federal authorities and use EPA's research to guide permit changes and oversight.
