Planning commission authorizes calling long-outstanding letters of credit for two subdivisions

The Franklin Municipal Planning Commission voted Jan. 22 to declare performance agreements in default and authorize the city to call letters of credit for two long-outstanding subdivision improvements.
Staff reported Dallas Towns subdivision (site plan Section 3) was approved with conditions in December 2010 and the performance agreement with letter of credit was issued in August 2013; staff identified outstanding landscaping and specimen-tree replacement deficiencies and recommended calling the $17,000 surety so the city can complete the work. No applicant or public speaker represented the project at the meeting. Commissioner Harrison moved to call the bond; Commissioner McLemore seconded; roll-call vote recorded ayes and the motion passed.
For Longview Subdivision (lots 11 and 12, universal storage), staff said the final plat was approved in April 2015 and the performance agreement and letter of credit were executed in November 2015. A prior reduction lowered the surety from $55,000 to $42,000 in 2019; staff said the applicant has not completed remaining improvements or responded to recent notices and recommended calling the surety. After a motion and second, the commission voted by roll call with ayes recorded and the motion passed.
Staff noted the city follows procedures that allow the developer options (release to maintenance, reduction, or a one-year extension) and that repeated extensions are no longer in the city or residents' interest when improvements remain incomplete.
