Supervisors questioned whether the ADU could be rented in the future. The applicant, who spoke remotely, said the structure's stated intent is multigenerational housing for his mother-in-law and that he had no present plan to rent it out: "My wife and I bought it roughly 12 to 13 years ago, the intent of it being a retirement property," he said. County Attorney Benny Zhang told the board that the county can impose reasonable conditions with a CUP, including an owner-occupancy requirement for the primary residence, and that such conditions run with the land and may be enforced or invalidate the CUP if violated.
After discussing whether to add an explicit owner-occupancy stipulation, Supervisor Edwards moved to approve the CUP; the motion carried by roll call with a majority in favor and one recorded objection. Planning staff will finalize permit paperwork to include the board's conditions and oversee compliance monitoring.
The board directed planning staff to incorporate any required conditions into the permit documents; staff said enforcement options include code compliance and potential termination of the CUP if conditions are violated.
