Council backs clarifications to reinstatement and probation rules, including competency requirement for long‑expired licenses

The Dental Assistant Council voted Feb. 5 to recommend legislative revisions clarifying procedures for petitions to reinstate revoked, surrendered or canceled licenses and for probationary license terms.
Pedro Galley, the board’s chief of administration and compliance, outlined proposed edits to Business and Professions Code section 16 86 and related sections that would (1) clarify timeframes for petition submission and prevent multiple back‑to‑back petitions, (2) add fingerprint submission requirements and fee clarifications, and (3) prohibit automatic reinstatement of scope‑of‑practice permits (for example, anesthesia or sedation permits) when a parent dental license is reinstated — those permits would have to be reapplied for through regular board processes.
The proposal would also authorize the board to require proof of competency — including clinical training or examination — as a condition before reinstating a license that has been revoked, surrendered or expired for five or more years. Galley said corrected packet language was provided at the start of the meeting and staff are available for questions.
Council member Miyazaki moved to recommend the revised option 2 language with a specified paragraph strike and renumbering; Epps Robbins seconded. After no public comment, the motion carried by unanimous roll call. Staff said they will submit the corrected language to the board for consideration and report back on next steps.
