Commissioners treated the encroachments as a property-owner dispute the developer must resolve; staff proposed a contingency preventing sale of affected lots until the encroachment matters are clarified. The commission voted to recommend approval of resolution 2025-017 with that contingency.
Next steps: staff will forward the recommendation and the draft resolution to the village board; resolution 2025-017 will appear on the board agenda for final action. The developer and landowners are responsible for resolving property-encroachment issues prior to sale of the impacted lots.
