Chairman Martin presented House Bill 818 as an administrative alignment to match retirement membership with the branch of government where the tax‑court judge now serves. Martin said last year’s constitutional amendment moved the position from the administrative/executive branch into the judiciary and HB 818 adjusts the retirement plan accordingly.
"We're trying to move that retirement system from ERS to JRS because the position itself moved from the administrative branch... into the judicial branch," Martin said, explaining that the change aligns contributions and benefit membership with the proper system.
Members asked whether the incumbent could elect to remain in ERS. Martin said the current appointee is in ERS and that the bill allows an election so an individual's benefits are not involuntarily forced into another retirement system. Staff from ERS confirmed the cleanup language requested clarifies effective dates and technical lines.
The committee adopted the sponsor’s do‑pass recommendation; the measure will proceed with required certification and rules steps.
