Commission approves Chipotle site waivers for tree and parking-lot landscaping, 6-0

The Greenwood Advisory Planning Commission on Feb. 9 approved by a 6-0 vote a set of waivers for a proposed Chipotle site (PC2025-038) that would allow the petitioner to relocate required frontage and perimeter trees and adjust parking-lot landscaping. Garrett Prime of Vanderbilt Law Firm represented Kevin Jones — petitioner for ECC Smith Valley Property LLC — and told the commission the waivers are necessary because a 15-foot sanitary sewer easement and a planned 10-foot asphalt trail constrict space for required street trees.
"We are not asking to diminish the number of trees. We're just asking to move them elsewhere on the site," Garrett Prime said. Staff reviewed the proposed relocations and recommended approval, asking only that one relocated tree be sited near a curved bypass lane at the northwest corner for visibility and spacing concerns. Commissioners approved the request and a second related waiver for perimeter planting relocation; both motions carried unanimously, 6-0.
Staff will verify tree placement and require the petitioner to show the relocated trees in the final landscape and construction plans. No other public opposition or significant policy questions were raised at the hearing.
Next steps: the petitioner will reflect staff’s requested tree placement on revised plans and move forward with site-plan and permitting processes consistent with the Unified Development Ordinance and staff conditions.
