Council reviews code updates to align with state law for microschools; Titles 10/11 recodification discussed

City staff told Holladay City Council on March 6 that proposed code changes will bring local ordinance into alignment with state law for home‑based microschools and microeducation entities.
Anne Garcia, community, economic development and housing manager, said the Moderate Income Housing Plan amendments are minor numeric edits intended to clarify annual reporting. On microschools, staff explained the new Title 5 chapter (5.63) would set consistent licensing and use rules in line with Senate Bill 13, which gives home‑based microschools similar requirements and rights as private and charter schools. “This proposed code amendment will ensure that Holladay’s code is consistent with the state code,” Garcia said. The Planning Commission recommended the changes in February.
Separately, council reviewed the recodification of Titles 10 and 11 (municipal code review). One council member raised the low‑profile motorized vehicle policy and suggested observing how enforcement and street classification play out before amending lanes or speed limitations. Staff said these code updates are routine and primarily intended to harmonize enforcement and programmatic language with state requirements.
Council expects to see formal resolution and ordinance language for these code updates on the March 20 agenda.
