Holiday Hills urges maintenance agreement as council hears Arbor Lane vacation proposal

Council opened a public hearing on July 7 on a proposed partial vacation of public right-of-way on Arbor Lane associated with a realignment tied to the Royal Holiday Hills development. Planning staff said the vacation would formalize the realignment, relocate utilities that have already been moved, and allow a subdivision plat (Arbor Plaza) to proceed.
Kathy Olson, director of development for the Holiday Hills project, told the council Holiday Hills previously dedicated several strips of land and installed irrigation and landscaping. Olson said she is willing to convey some strips to a new landowner but requested that any conveyance include an agreement preserving the appearance and maintenance standard (same plant material and same quality of maintenance) so the city does not end up with asymmetrical landscaping. "We're okay with conveying it to him, but we would need some kinds of agreement in place," Olson said.
Council and staff confirmed utilities had been moved and that private irrigation lines remain maintained by Holiday Hills; staff noted the vacation is intended to be addressed through a subdivision plat and that cross-access and maintenance easements could be worked out on the plat. Several council members agreed to continue the discussion in the work session and to negotiate maintenance and easement language with the developer and the new property owner before final plat recordation.
